By reading the below you will have a clear understanding of what your (future user) and Egolf’s (provider) rights are when bound in a working relationship. Please contact us if you have any concerns or questions about any of the egolf Terms and Conditions or Privacy Policies.

Acceptance of terms and conditions: ‘eGolf’ services are provided by EGOLF GLOBAL LIMITED. By accessing ‘eGolf’ WEB pages direct and/or through third party websites you agree to the terms and conditions following. If you disagree to any part of the following terms, you are not allowed to use nor access this site.

Amendment of terms and conditions: These terms and conditions may be amended in whole or in part by ‘eGolf’ from time to time. Amendments will be effective immediately upon posting of the amended terms and conditions on this Website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of the Services represents your agreement to be bound by the terms and conditions as amended.

Provision of the Services by ‘eGolf’: ‘eGolf’ is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Services which ‘eGolf’ provides may change from time to time without prior notice to you.

As part of this continuing innovation, you acknowledge and agree that ‘eGolf’ may stop (permanently or temporarily) providing any features within the Services to you or to users generally at eGolf’s sole discretion, without prior notice to you. You may stop using the Services at any time.

You acknowledge and agree that if ‘eGolf’ disables access to your account, you may be prevented from accessing the Services, your account details or any files or other content which is contained in your account.

You acknowledge and agree that while ‘eGolf’ may not currently have set a fixed upper limit on the number of transmissions you may send or receive through the Services or on the amount of storage space used for the provision of any Service, such fixed upper limits may be set by ‘eGolf’ at any time, at eGolf’s discretion.

Your Passwords and Account Security: You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with your account you use to access the Services.

Accordingly, you agree that you will be solely responsible to ‘eGolf’ for all activities that occur under your account. If you become aware of any unauthorized use of your password or of your account, you agree to notify ‘eGolf’ immediately at support@egolf.co.nz

Content in the Services: The contents of ‘eGolf’ WEB pages are Copyright © 2014 EGOLF GLOBAL LIMITED. Any rights not expressly granted herein are reserved. You may not, reproduce, store, copy, distribute, modify, transmit, reuse or deface any part of any ‘eGolf’ WEB pages.

You should be aware that Content presented to you as part of the Services, including but not limited to advertisements in the Services and sponsored Content within the Services may be protected by intellectual property rights which are owned by the sponsors or advertisers who provide that Content to ‘eGolf’ (or by other persons or companies on their behalf). You may not modify, rent, lease, loan, sell, distribute or create derivative works based on this Content (either in whole or in part) unless you have been specifically told that you may do so by ‘eGolf’ or by the owners of that Content, in a separate agreement.

You agree that you are solely responsible for (and that ‘eGolf’ has no responsibility to you or to any third party for) any Content that you create, transmit or display while using the Services and for the consequences of your actions (including any loss or damage which ‘eGolf’ may suffer) by doing so.

Links in the Services: ‘eGolf’ may include links to sites on the Internet that are outside of ‘eGolf’ WEB site and owned or operated by other parties. By linking to such other sites, you shall review and agree to that site’s rules of use before using such site. You also agree that ‘eGolf’ has no control over the content of that site and cannot assume any responsibility for material created or published by such other site. In addition, a link to a non-’eGolf’ site does not imply that ‘eGolf’ endorses the site or the products or services referenced in such other site.

Fees:
A valid credit card is required for payments. A credit card is not required to start a free trial, and you will only need to supply this if you wish to continue with a paid subscription account.

Credit card security is implemented using https (256-bit encryption) on all transactions. Credit card details are not stored within the ‘eGolf’ application. Your credit card details are stored at a trusted and secure payment gateway used by ‘eGolf’ for payment processing.

All monthly subscription fees must be paid monthly in advance.

If you have any questions about charges made to your account, please contact us immediately. If there are charges made in error, we will credit your account or credit card account for the appropriate amount.

SMS reminders (an optional feature) are charged per SMS sent. You are responsible for ensuring you have sufficient credit for SMS reminders (these are charged separately from the monthly subscription). Refunds will not be issue for unused SMS reminder credits if you cancel your account.

Cancellation and Termination:
You are solely responsible for the cancellation of your account. You can cancel your account at any time through the settings/subscription area of the application. Email or phone requests to cancel your account are not considered a cancellation.All of your content and data will be deleted 90 days after cancellation or termination of your account. This information will not be able to be recovered. We recommend you use the export functionality of the Service prior to cancellation to retain any information you may require.

Failure to pay your subscription fees will result in your account being suspended. Accounts are suspended for a maximum of 90 days before the account may be terminated by us. We are not responsible for any loss you suffer as a result of such suspension or termination. A suspended account can be reactivated by supplying valid payment credentials and resuming your subscription.

If you cancel your account before the end of your currently paid month, you will not be entitled to a refund. Cancelling your subscription is effective immediately. However, you still be able to access all features until the end of current billing cycle. After the end of current billing cycle, you will only have access to export your information or reactive your account. The rest of the functionality will be disabled.

Privacy and your personal information:
‘eGolf’ collects personal information about you through your use of the Services, including:

your registration details; and information relating to your use of the Website and the content you access.
You agree that ‘eGolf’ may use this personal information to assist us to provide the Services to you, for internal research purposes, to verify your identity, for promoting and marketing other products and services provided by EGOLF GLOBAL LIMITED to you, and for any other use that you authorise.

We will not sell or allow third parties to access your personal information without your consent. For more information about eGolf’s data protection practices, please read eGolf’s Privacy Policy. This policy explains how eGolf treats your personal information, and protects your privacy, when you use the Services.

WE DO NOT HAVE ANY OBLIGATIONS TO PROTECT YOUR PERSONAL INFORMATION WHICH PROVIDED BY YOU TO COACHES AND/OR GROUPS WHO USE eGolf AS A COACHING SOFTWARE. YOU MUST AGREE WITH THEIR TERMS AND CONDITIONS AND PRIVACY POLICY BEFORE YOU ACCEPT OUR TERMS AND CONDITIONS AND PRIVACY POLICY.
